1. Introduction
Hot Take LLC ("Company," "we," "us," or "our") operates The Stunt (the "App" or "Service"). This Privacy Policy describes how we collect, use, share, and protect information about you when you use the App. By using the App, you agree to the practices described in this Privacy Policy. If you do not agree, do not use the App.
The App is intended only for users 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we learn we have collected personal information from a user under 18, we will delete it.
2. Information We Collect
2.1 Information You Provide
- Account information: name, username, date of birth, email address, phone number, password, profile photo, and any other information you choose to provide.
- Verification information: government-issued ID (e.g., driver's license, passport), photo or selfie, address, Social Security Number (last four digits) or other tax identifier, and similar information required to verify your age, identity, and eligibility.
- Payment information: payment card details, bank account or ACH details, or other financial account information, processed by our payment processors.
- Tax information: information necessary to issue tax forms (e.g., IRS Form 1099) or comply with reporting and withholding obligations.
- User-generated content: messages, audio/voice content, profile bio, comments, contest activity, and any other content you submit through social features of the App.
- Communications: emails, support tickets, and other communications with us.
2.2 Information Collected Automatically
- Device information: device model, operating system, unique device identifiers, mobile network information, browser type, and language settings.
- Usage information: contests entered, scores, leaderboard standings, in-app actions, pages viewed, features used, timestamps, and performance data.
- Location information: precise geolocation (via GPS, Wi-Fi, IP address, or other signals) when required to verify that you are located in a permitted jurisdiction. You may be required to enable location services to use paid contests.
- Log and analytics data: IP address, access times, referring URLs, crash reports, and diagnostic data, collected via cookies, SDKs, and similar technologies.
2.3 Information From Third Parties
- Identity verification, age verification, and anti-fraud providers (e.g., KYC/IDV vendors);
- Geolocation compliance providers used to confirm your eligible location;
- Payment processors and financial partners;
- Analytics, advertising, and attribution partners;
- Social or login providers if you choose to connect them;
- Publicly available sources and other parties where permitted by law.
3. How We Use Your Information
We use information for the following purposes:
- Provide, operate, maintain, and improve the App and contests;
- Create and manage your account, including authentication and security;
- Verify your age, identity, residency, and physical location, and detect and prevent fraud, multi-accounting, collusion, and abuse;
- Process deposits, wagers, prizes, withdrawals, refunds (where applicable), and tax reporting;
- Calculate scores, rankings, and prize distributions;
- Provide customer support and respond to your inquiries;
- Send transactional messages (e.g., receipts, account alerts) and, where permitted, marketing communications (which you may opt out of);
- Personalize and recommend content and contests;
- Monitor and analyze usage, trends, and performance for analytics and product improvement;
- Enforce our Terms, Community Rules, and other policies;
- Comply with legal obligations, court orders, regulatory requests, and applicable law.
4. How We Share Information
We do not sell your personal information for money. We may share information as follows:
- Service providers: with vendors who perform services on our behalf (e.g., hosting, payments, identity and age verification, geolocation, analytics, customer support, fraud prevention, email delivery, and cloud infrastructure).
- Other users: certain information, such as your username, profile photo, follower relationships, leaderboard standing, contest results, and public User Content, is visible to other users of the App.
- P2P opponents: when you enter a peer-to-peer challenge, your username and challenge results are shared with your opponent.
- Legal and safety: with law enforcement, regulators, courts, or other parties when we believe disclosure is necessary to comply with law, enforce our Terms, protect rights, property, or safety, or investigate fraud or wrongdoing.
- Business transfers: in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, subject to standard confidentiality protections.
- With your consent: with any other party where you direct us to do so.
Some sharing for analytics or advertising purposes may be considered a "sale" or "share" of personal information under certain U.S. state privacy laws. See Section 7 below for your rights.
5. Cookies and Similar Technologies
We and our partners use cookies, SDKs, pixels, and similar technologies to operate and analyze the App, authenticate users, remember preferences, detect fraud, and measure marketing performance. You can manage cookies through your browser or device settings, though some features of the App may not function properly without them.
6. Data Retention
We retain personal information for as long as needed to provide the App, comply with our legal, regulatory, tax, and accounting obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of data and applicable legal requirements. When we no longer need information, we will delete, anonymize, or aggregate it.
7. Your Rights and Choices
Depending on your jurisdiction, you may have the right to:
- Access the personal information we hold about you;
- Correct inaccurate or incomplete information;
- Request deletion of your personal information, subject to our legal and regulatory retention obligations;
- Object to or restrict certain processing;
- Request portability of your data;
- Opt out of "sales" or "sharing" of personal information and certain targeted advertising or profiling, where applicable;
- Withdraw consent, where processing is based on consent;
- Lodge a complaint with a data protection authority.
To exercise any of these rights, contact us at team@thestunt.com. We may need to verify your identity before fulfilling your request. We will not discriminate against you for exercising your rights.
7.1 California Residents
If you are a California resident, you have the rights described under the California Consumer Privacy Act (CCPA), as amended by the CPRA, including the right to know, delete, correct, and opt out of the sale or sharing of personal information. We do not knowingly sell the personal information of consumers under 16.
7.2 Other U.S. State Privacy Laws
Residents of certain other U.S. states (including but not limited to Virginia, Colorado, Connecticut, Utah, and Texas) may have similar rights under applicable state privacy laws. You may exercise these rights by contacting team@thestunt.com.
8. Marketing Communications
You can opt out of promotional emails or push notifications by following the unsubscribe instructions in those communications or adjusting your device or in-app notification settings. We will continue to send you transactional communications related to your account, contests, payments, and legal notices.
9. Data Security
We use commercially reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure. You are responsible for keeping your account credentials confidential and notifying us immediately of any unauthorized access at team@thestunt.com.
10. International Users
The App is operated from the United States. If you access the App from outside the United States, your information will be transferred to, stored, and processed in the United States, which may have data protection laws different from those of your country. By using the App, you consent to such transfer.
11. Third-Party Links and Services
The App may contain links to third-party websites, services, or applications. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them any information.
12. Children's Privacy
The App is not directed to, and does not knowingly collect personal information from, anyone under 18 years of age. If you believe a person under 18 has provided us with personal information, please contact team@thestunt.com and we will take appropriate steps to delete it.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The "Effective Date" at the top reflects the latest revision. Material changes will be communicated through the App or by email. Your continued use of the App after changes become effective constitutes your acceptance of the updated Privacy Policy.
